Korea’s Revised Export Control of Strategic Items: Three Things Foreign Companies Should Know

2026.10.14.

Korea’s Ministry of Trade, Industry and Resources (“MOTIR,” formerly the Ministry of Trade, Industry and Energy) has amended the Public Notice on Trade of Strategic Items (the “Notice”), which implements Korea’s export controls on strategic items under the Foreign Trade Act. The amendment took effect on September 1, 2026. In Korea, “strategic items” are goods, software, and technology that require an export license because of their potential use in weapons or their means of delivery; most are dual-use items.

The amendment affects multinational companies with manufacturing or sales subsidiaries in Korea, foreign companies that purchase controlled items from Korean suppliers, and compliance teams at headquarters that manage export classification centrally for all affiliates worldwide. The practical point is that foreign counterparties may now be asked for more detailed end-user, resale, and final-destination information before shipments from Korea can proceed. In this Legal Update, we highlight three points for companies outside Korea.
