Restrictive Covenants, Protection of Intellectual Property, and Data Privacy

Practical and legal solutions for protecting trade secrets and IP, and managing employees’ personal information.

Introduction

For businesses to maintain a competitive edge, protecting core confidential information and intellectual property has never been more essential. We advise our clients on how to effectively protect their confidential information, trade secrets, know-how, and other IP through preventive measures and post hoc legal action where necessary to enforce restrictive covenants, including non-compete agreements. We also frequently advise clients on how to handle employee personal information in accordance with Korea’s data-privacy laws, which are among the most complicated and strict in the world. The collection, use, and transfer of employee personal information (including transfers to affiliates) is heavily regulated in Korea, and these activities typically begin at the job-application stage and continue even after the employment relationship ends. We help clients understand and comply with critical laws such as the Act on Promotion of Information and Communication Network Utilization and Information Protection, and the Personal Information Protection Act.
