Dark Pattern Crackdown Looms as Drip Pricing Grace Period Ends - Updated KFTC Q&A Clarifies How to Comply
2025.08.07.
The Korea Fair Trade Commission (the “KFTC”) is gearing up for on-site inspections and enforcement actions as the grace period for self-correction of drip pricing practices expires on August 13, 2025, bringing all dark pattern regulations into full effect.
On February 14, 2025, amendments to the Act on Consumer Protection in Electronic Commerce (the “E-Commerce Act”) and its related enforcement regulations took effect, targeting six types of deceptive online commerce practices, or “dark patterns”: hidden renewals, drip pricing, pre-selected purchase options, misleading hierarchies, obstruction of cancellation or withdrawal, and repeated interference. Of these, the KFTC provided a six-month grace period for compliance with drip pricing regulations.
As this grace period expires, the KFTC plans to conduct proactive ex-officio investigations and impose strict sanctions for violations, including corrective orders and administrative fines. In the lead up to enforcement, the KFTC published an updated Q&A guidance document to help e-commerce providers understand and comply with the new rules. The Q&A includes real-world examples and compliance standards to assist businesses in reviewing and adjusting their user interfaces and business practices.
