On Dec. 29, 2023, the Korea Fair Trade Commission (the "KFTC") issued draft Guidelines on Unfair Trade Practices in the Franchise Sector (the “Draft Guidelines”). The Draft Guidelines, open to public comments until Jan. 18, 2024, seek to enhance consistency in the enforcement of the Fair Transactions in Franchise Business Act (the “Act”) and to prevent violations of the statute by franchisors. To that end, the document offers guidelines tailored to the franchise sector, reflecting the unique characteristics of the franchise sector. Specifically, the Draft Guidelines provide the evaluation criteria for each type of unfair trade practice under the Act, along with examples of violations.
