Yulchon successfully assisted a multinational service platform company during its labor inspection conducted by the Ministry of Employment and Labor (MOEL). Our assistance encompassed a comprehensive review of our client’s compliance with labor and employment laws, covering labor standards, maternity protection, and the employment of non-regular workers. Additionally, Yulchon conducted a thorough risk analysis, prepared strategic guidance for the client to face the labor inspection, and provided on-site assistance to on the day of inspection. As a result, the MOEL found no violations.

This case was distinctive because our client’s corporate culture, influenced by its foreign headquarters, differs from the norm in Korea. For instance, our client granted its employees significant autonomy in managing attendance, working hours, and annual leave. Consequently, this autonomy raised concerns about the company’s compliance with overtime pay requirements and compensation for work during days off, which could potentially result in corrective orders and significant financial liability. Additionally, there were potential issues related to dispatched workers and discrimination against non-regular employees. Specifically, the company could have faced fines for violations of employment-contract requirements for fixed-term workers.

Leveraging our extensive experience in guiding clients through labor inspections, Yulchon identified several risks and formulated strategies for responding to the inspection and explaining the company’s practices. By being on-site during the inspection, we effectively communicated the client’s distinctive organizational culture to the MOEL, preventing confusion and misunderstandings that could have resulted in legal violations.

This matter holds significance as Yulchon was able to assist a multinational company with a workforce culture and practice that differ significantly from Korean norms, successfully navigating a labor inspection. Our success strengthened our trust and partnership with the client, further highlighting Yulchon's expertise in handling labor inspections—an area that poses challenges for many businesses in Korea. This accomplishment reinforces the trust our clients have in us regarding labor-related matters.
