Yulchon represented ILJIN Group (“ILJIN”), an ascon/ready-mixed concrete manufacturing company, in an appeal over revocation litigation involving a shutdown order of its ascon factory, and resulted in a ruling reversing and remanding the lower court’s decision.
Despite ILJIN having operated an ascon factory established by lawful procedures within the planned management area since 2000, the Governor of Gyeonggi Province issued a shutdown order on the grounds that the installment of ascon factory within the planned management area is prohibited after the amendment of the Enforcement Rules of the Clean Air Conservation Act in 2005 due to harmful substances discharged from such factory, and the courts of first and second instances determined that such disposition is reasonable.
