Yulchon attorneys speak at the IBA 5th Asia-based International Financial Law Conference

Sy Nae KIM and Jay-Son YANG attended the IBA 5th Asia-based International Financial Law Conference held in Seoul from September 10 to 12 as speakers. 


Ms. KIM spoke on “Rise in collapsed real estate deals – workouts and potential disputes”, regarding the recent difficulties in the Asian real estate market, cross-border disputes arising therefrom, and exit strategies such as workouts and insolvency procedures. 


Ms. YANG participated in “Governance of financial institutions: new South Korean requirement on responsibilities map for internal controls and risk management” session and “Investor activism including activism regarding greenwashing by corporate issuers”, for two consecutive days. 


In the first session, Ms. Yang focused on the Responsibility Map that was introduced along with the recent amendments to Korea’s Corporate Governance Act. She discussed the key issues observed during the early implementation of the system and offered practical suggestions for improvement. In the second session, Ms. Yang addressed the recent trends in shareholder activism in —including the government’s and market participants’ active efforts to relieve the so-called “Korea Discount.” She also explored how these developments intersect with ESG-based management practices.


This conference was jointly hosted by the IBA Banking & Financial Law Committee and the IBA Securities and Capital Markets Committee, with the support of the IBA Asia Pacific Regional Forum. It served as a forum to examine key issues in banking and financial law and capital markets, and to compare the latest trends across different countries and regions.
