National Assembly Passes Amendments to Energy-Related Laws: Key Changes to the Renewable Energy Act and Hydrogen Act

On February 12, 2026, a set of eight legislative amendments under the jurisdiction of the Ministry of Climate, Energy and Environment, including revisions to the Act on the Promotion of the Development, Use and Diffusion of New and Renewable Energy (the “Renewable Energy Act”) and the Hydrogen Economy Promotion and Hydrogen Safety Management Act (the “Hydrogen Act”), passed the plenary session of the National Assembly. While the legislative package also includes amendments aimed largely at procedural refinement—such as those concerning the River Act and the Act on Construction and Management of Dams and Assistance to Their Environs—the practical and strategic center of gravity lies in the amendments to the Renewable Energy Act and the Hydrogen Act, which reconfigure the renewable energy legal architecture and rationalize siting-distance regulations.
In particular, the concept previously referred to as “new and renewable energy” has been redefined in line with international standards articulated by the International Energy Agency (IEA), and related regulations have been adjusted to better reflect current realities, which is expected to bring significant changes to the future business environment. The principal elements of the reform are, among others, (1) structural reorganization of new and renewable energy statutory regimes and transfer of relevant provisions for regulatory coherence, (2) principle-based prohibition and standardization of siting distance requirements and (3) consolidation of hydrogen-related provisions within the Hydrogen Act.
In this Legal Update, we examine the key features of the amended Renewable Energy Act and Hydrogen Act—the central pillars of the recent energy law reform—and their practical implications for businesses and investors operating in the energy landscape.
