PIPC Publishes New Guideline on the Protection and Use of Personal Visual Data for Mobile Visual Data Processing Devices

In September 2023, the Personal Information Protection Act (PIPA) was amended to establish under Article 25-2 a legal basis for recording videos of identifiable individuals ("Personal Visual Data") in public spaces for business purposes using mobile visual data processing devices, such as autonomous vehicles, robots, drones, and body cameras (collectively, "Visual Devices"). 

Then, on October 14, 2024, the Personal Information Protection Commission (PIPC) announced the release of the Guideline on the Protection and Use of Personal Visual Data for Mobile Visual Data Processing Devices (the "Guideline"). The Guideline was issued to address regulatory uncertainties related to the above provisions, promote the safe use of Visual Devices, and support the development of related industries and technologies.

The Guideline provides a detailed explanation of eight core principles that operators of Visual Devices ("Visual Device Operators") must follow when capturing (collecting) Personal Visual Data in public spaces for business purposes. It also outlines specific compliance requirements and recommended practices for each stage of processing Personal Visual Data.
