The Mergepoint scandal has had a significant impact in Korea, resulting in
a large number of victims. Those involved in the scandal were detained for
investigation and are now facing criminal charges. Some of the victims filed a
civil lawsuit against those involved in the scandal, seeking compensation for
damages. The defendants in this civil lawsuit included e-commerce business
operators that had sold the Mergepoint service. They were accused of joint
tort liability. The court of first instance (the “Court”) has recently rendered
judgment (Seoul Central District Court Decision 2021Gahap2702) and denied
the e-commerce business operators’ liabilities for damages. This newsletter will
introduce the legal principles that the Court applied in rendering its judgment
regarding the liabilities of e-commerce platforms.
