Advisory and Consulting Services on the Amendments to the Radiation Disaster Act on Behalf of the Nuclear Safety Technology Institute

Yulchon successfully provided advisory and consulting services on behalf of the Nuclear Safety Technology Institute, offering amendment recommendations for the penalty provisions of the Act on the Physical Protection and Radiological Emergency Measures for Nuclear Facilities (“Radiation Disaster Act”).


Leveraging its accumulated knowledge and experience in nuclear-related laws, Yulchon reviewed various ongoing management activities aimed at ensuring the safety of nuclear facilities, identified problematic issues in the current legal framework and related systems, and conducted an analysis of relevant domestic and international laws. Based on this research, Yulchon proposed amendments to the Radiation Disaster Act and its enforcement decree, including the diversification of administrative fines and the introduction of penalty surcharges.


This matter was the first time in South Korea where improvements to penalty regulations concerning the physical protection of nuclear facilities were suggested, and the recommended amendments could serve as reference for future amendments to the Radiation Disaster Act. This engagement demonstrates Yulchon’s expertise in the energy sector, including nuclear power.
