Yulchon Achieved a Significant Victory on behalf of Corning Inc., a Leading Glass Manufacturer, Successfully Defending against Patent Invalidation Challenges Brought by Their Competitor AGC Inc., through an Invalidation Trial and Subsequent Supreme Court Appeal

In order to safeguard its valuable intellectual property concerning strengthened cover glass utilized in billions of displays and portable devices, Corning initiated enforcement actions against AGC, Inc. (formerly Asahi Glass Co.; “AGC”), one of its main competitors. This sparked a multi-country patent dispute between the two rivals, each vying for dominance in the strengthened cover glass market. AGC retaliated with patent invalidation trials in China and Korea.
Equipped with the relevant technical knowledge and extensive experience in invalidity trials and patent cases in multiple jurisdictions, Yulchon was chosen to defend the validity of Corning’s valuable patent in Korea. Over the course of three years, Yulchon worked closely with Corning, aligning their efforts with Corning's global litigation strategy to build a robust case. As a result, Yulchon achieved success at the Korean Intellectual Property Trial and Appeal Board (“KIPTAB”) and successfully defended against appeals brought by AGC at the Korean IP High Court (formerly known as the Patent Court), ultimately reaching the Supreme Court of Korea.
