Yulchon
represented White Stone in an investigation conducted by the Korean Trade
Commission (“KTC”) involving allegations of patent infringement by imported
goods, and successfully obtained an exclusion order barring the infringing
products from entry into Korea.
White Stone is
a manufacturer of a screen protector of smartphones called Dome Glass. When White Stone discovered that third
parties intended to import and sell the products that violate its Dome Glass
intellectual property rights, it sought Yulchon’s legal advice. Yulchon promptly filed a petition seeking the
initiation of an unfair importation investigation by the KTC and successfully
persuaded the KTC that the products at issue infringe White Stone’s patent covering
its Dome Glass. As a result, the KTC granted an exclusion order banning the
importation of the infringing products, an order to destroy any remaining
inventory of the infringing products, and an order to pay an administrative
fine.
This case is
significant in that Yulchon was able to stop infringing products before they
entered Korea, thereby thoroughly and effectively preventing any damages that
such infringing products could have caused had they entered the domestic
market.
