Success in Obtaining Administrative Sanction Against a Trademark Infringer in Vietnam

Yulchon represented a Korean company, referred to as "Company A," in a trademark infringement case in Vietnam. We successfully secured an administrative fine of VND 90 million and an 18-month suspension of business against the trademark infringer, a Vietnamese company.
The infringer had been using a trade name and logo similar to those of Company A within Vietnam. Furthermore, they used photos of Company A's physicians without authorization and engaged in improper solicitation of customers by falsely advertising themselves as a Vietnamese subsidiary of Company A on social media and other platforms. Upon becoming Company A's legal counsel, Yulchon's Vietnam office collaborated with a local IP law firm to register Company A's trademarks in Vietnam. We also initiated a request with local health authorities to conduct an administrative investigation into the infringer's activities.
Additionally, our preliminary survey revealed that the infringer had been operating a medical practice without the necessary license. We promptly informed the local health authorities, who took action accordingly by imposing fines and suspending the infringer's business operations.
This case holds significance as we proactively presented measures to effectively cease trademark infringement against a domestic company in Vietnam even before trademark registration was completed. Our efforts resulted in successful outcomes, underscoring Yulchon's commitment to protecting the interests of our clients and upholding intellectual property rights.
